Subject: 10122/1994-210 Shadden, Tim (Revised) Date: Mon, 27 Feb 1989 12:20:00 -0500 1994-210 Tim Shadden ORDINANCE NO. 10122 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED IN THE 6200 BLOCK OF LEE HIGHWAY, BEING ON THE SOUTHEAST LINE OF LEE HIGHWAY AT VANCE ROAD, FROM R-2 RESIDENTIAL ZONE TO C-2 CONVENIENCE COMMERCIAL ZONE, SUBJECT TO CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located in the 6200 block of Lee Highway, being on the southeast line of Lee Highway at Vance Road. Part of tract 4, Partition of the Sallie M. Conner Tract, as shown by plat of record in plat book 14, page 8, ROHC; being part of the property described as Tract II in deed book 1923, page 632, ROHC. Said part of tract begins at the intersection of the southeast line of Lee Highway (as now widened) with the southeast line of Vance Road, thence northeast some 55 feet with Lee Highway to the existing C-2 zoning line, thence with said zoning line southeast some 360 feet to the southwest line of lot 1B, Resubdivision of Lot One, Perimeter Park Subdivision, as shown by plat of record in plat book 50, page 38, ROHC, thence southeast some 320 feet with said lot line to the existing C-2 zoning line, thence southwest some 70 feet with said zoning line, thence southwest some 765 feet to the southeast line of Vance Road, thence northeast 800 feet with Vance Road to the southeast line of Lee Highway, the point of beginning. Tax Map No. 148O-C-2 (part). from R-2 Residential Zone to C-2 Convenience Commercial Zone. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. Subject to dedication of right-of-way as required by City Traffic Engineer (for 30' from centerline). 2. Subject to landscaping along Vance Road. 3. Access subject to approval by City Traffic Engineer. 4. The growth corridor landscaping requirements shall be met; however, the tree planting schedule of that policy will not be required within two hundred (200) feet of the intersection of Vance Road and Lee Highway. 5. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, as required by law.
